This Liability Waiver and Release of Claims (“Waiver”) is made and entered into as of the date set forth below by and between Powerhouse Training LLC (hereinafter referred to as "the Company") and the undersigned student (hereinafter referred to as “Student”).
By enrolling in and attending any tutoring sessions, classes, or other educational services provided by the Company, whether in-person, online, or in any other format (collectively, “Tutoring Services”), the Student agrees to the following terms and conditions:
The Student acknowledges and agrees that the Tutoring Services provided by the Company are intended to supplement the Student’s preparation for the Florida real estate licensing exam and are not a substitute for the education requirements set forth by the State of Florida. The Student must still complete any state-mandated pre-licensing courses, continuing education, and other requirements to be eligible for the real estate licensing exam. The Company does not issue academic credit, and participation in the Tutoring Services does not fulfill any official education requirement set by the state.
The Student understands and agrees that the instructors providing the Tutoring Services are tutors, not professors, certified educators, or legal advisors. While tutors are experienced and knowledgeable in the field of real estate, they are not accredited by any educational institution and do not hold the authority to issue grades, certifications, or official educational credentials. The Tutoring Services are designed to assist with exam preparation by providing guidance, support, and educational resources.
The Student acknowledges and agrees that the Company does not guarantee that the Student will pass the Florida real estate licensing exam or any other examination as a result of participating in the Tutoring Services. The Company’s role is to provide educational support, guidance, and resources to aid in the Student's preparation, but the ultimate responsibility for learning, understanding, and applying the material rests with the Student.
The Student understands and agrees that the Company makes every effort to provide accurate and up-to-date information in its Tutoring Services. However, the Company does not guarantee the accuracy, completeness, or reliability of any information provided. Laws, regulations, and market conditions may change, and it is the Student's responsibility to verify any information obtained through the Tutoring Services before relying on it for exam preparation or any other purpose.
The Student agrees to release, waive, discharge, and hold harmless the Company, its owners, instructors, employees, agents, and representatives from any and all claims, demands, causes of action, damages, or liabilities arising out of or related to the Student’s participation in the Tutoring Services, including but not limited to:
Any direct, indirect, incidental, consequential, or special damages arising from the use or inability to use the materials or information provided during the Tutoring Services.
Any errors or omissions in the materials or information provided.
The Student’s failure to pass the Florida real estate licensing exam or any other examination.
Any personal injury, property damage, or other harm that may occur while participating in in-person tutoring sessions or classes, whether caused by negligence or otherwise.
The Student acknowledges that participating in the Tutoring Services involves certain risks, including, but not limited to, the risk of academic failure, misunderstanding of material, and potential exposure to health risks in in-person settings. The Student voluntarily assumes all such risks, both known and unknown, related to participation in the Tutoring Services.
The Tutoring Services provided by the Company are for educational purposes only and should not be considered professional, legal, or financial advice. The Student is responsible for seeking independent advice from a licensed professional for any specific legal, financial, or real estate matters.
The Student agrees to indemnify, defend, and hold harmless the Company, its owners, instructors, employees, agents, and representatives from any and all claims, actions, liabilities, costs, and expenses (including attorneys’ fees) arising from or related to the Student’s participation in the Tutoring Services, violation of this Waiver, or infringement of any intellectual property or other rights of the Company or third parties.
If participating in in-person Tutoring Services, the Student agrees to abide by all rules and regulations of the Company’s facilities. The Student also agrees to use any online platforms provided by the Company in accordance with applicable terms of use, and acknowledges that the Company is not responsible for any technical issues, internet outages, or other disruptions that may affect the Student’s access to online Tutoring Services.
The Student acknowledges that they have read and understand this Waiver, and that they are signing it voluntarily. The Student understands that by signing this Waiver, they are waiving certain legal rights, including the right to sue or claim compensation in the event of loss or injury.
If any provision of this Waiver is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions will remain in full force and effect.
This Waiver shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles. Any legal action or proceeding arising out of or related to this Waiver shall be brought exclusively in the state or federal courts located in Florida.
This Waiver constitutes the entire agreement between the Student and the Company with respect to the subject matter hereof and supersedes all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between the Student and the Company.
